These Terms and Conditions (“Terms”) form a legally binding agreement between you (“User,” or “Driver”) and Guardian Transport & Courier LLC (“the Company,” “we,” “us,” or “our”). By accessing or using the Guardian Transport & Courier mobile application or website (“the Platform”), you agree to abide by these Terms and our Privacy Policy. If you do not agree, discontinue use immediately.

1. Faith-Based Foundation and Core Standards

Guardian Transport & Courier LLC operates on Christian principles of honesty, integrity, safety, and respect for every individual. Riders and Drivers are expected to uphold these same standards in all conduct and interactions.

2. Services Provided

Guardian Transport & Courier LLC provides a technology platform that connects independent Drivers with Riders seeking transportation.

We do not:
• Operate as a common carrier
• Own or manage vehicles
• Employ Drivers

Drivers are independent contractors, responsible for their own vehicles, insurance, expenses, and tax obligations.

Guardian Transport & Courier oversees platform operations, safety procedures, and verification processes but does not guarantee the conduct or performance of Riders or Drivers.

3. Driver Qualification, Background Checks & MVR Requirements

To maintain the highest levels of safety:
• Drivers must complete a comprehensive criminal background check.
• Drivers must undergo fingerprint-based identity verification.
• Background checks are ongoing and reviewed regularly.
• Drivers must submit a Motor Vehicle Record (MVR) every quarter.Drivers must submit all required documents for onboarding, including but not limited to vehicle registration, insurance, valid driver license from the State of Tennessee.
• Drivers who fail to meet standards may be suspended or removed.

Vehicles must be insured, registered, clean, and in safe operating condition.

4. Eligibility Requirements

Users must:
• Be at least 18 years old
• Provide accurate and complete registration information
• Comply with all applicable laws
• Maintain required insurance and licensing (Drivers)

The Company may suspend or refuse service to anyone who violates these Terms.

5. Rider Responsibilities

Riders agree to:
• Treat Drivers, vehicles, and other passengers with courtesy and respect
• Be on time for pickup
• Follow Driver instructions that ensure safety
• Pay all fares, fees, waiting charges, and applicable costs
• Avoid damaging or excessively dirtying the vehicle

Food & Drink Policy
Drivers may prohibit open food or drinks. Eating or drinking in the vehicle may result in early termination of the ride.

6. Cleaning & Damage Fees

Riders are responsible for any cleaning or repair costs resulting from spills, damage, bodily fluids, or any condition requiring professional cleaning or rendering the vehicle unusable.

Cleaning and damage fees include, but are not limited to:
• Standard cleaning due to spills or mess
• Biohazard cleanup (vomiting or bodily fluids)
• Damage to interior or exterior surfaces
• Any condition preventing the Driver from continuing service

All cleaning and damage costs will be based upon the final invoice from a certified professional cleaning company.
The full invoiced amount will be charged to the Rider’s payment method on file.

Prohibited in all vehicles:
• Smoking or vaping of any kind
• Consuming alcohol or possessing open alcoholic beverages

7. Driver Responsibilities

Drivers agree to:
• Behave respectfully and professionally
• Maintain a clean, safe, insured, and well-maintained vehicle
• Comply with all traffic laws
• Keep licensing, registration, and insurance up to date
• Accept and complete trip requests through the Platform
• Uphold the values and safety commitments of Guardian Transport & Courier

Drivers are independent contractors responsible for their expenses and vehicle operation.

8. Booking, Pricing & Adjustments

Prices are shown before booking and may vary based on distance, service class, location, time, and demand.

Prices may be adjusted if:
• The Rider changes the destination
• Additional stops are added
• The route changes at Rider request
• Traffic or delays significantly extend travel time
• Excessive waiting occurs

9. Wait Time Policy

• First 15 minutes after Driver arrival: complimentary.
• After 15 minutes: $10 per additional 15-minute period.
• After 45 minutes without Rider arrival, the Driver may cancel the trip.
• Cancellation fee will apply.

10. Cancellation & No-Show Policy

• Cancelling a confirmed ride within 60 minutes of pickup-or after the Driver is en route-results in a $20 cancellation fee.
• No-show occurs when a Rider fails to appear within 5 minutes (or 15 minutes with wait time).
• No-shows may incur cancellation and waiting charges.
• Excessive cancellations or no-shows may result in account suspension.

11. If the Car Doesn't Arrive

If your Driver does not arrive, contact Guardian Transport & Courier immediately through the app or website. Having your trip ID ready helps expedite assistance.

12. Lost & Found

• Drivers assist with loading and unloading baggage.
• Riders are responsible for their belongings.
• Items found must be given to the Driver.
• Unclaimed items are turned over to local law enforcement lost-and-found.

13. Payment Terms

Payment is processed securely through the Platform.

Riders authorize charges for:
• The calculated fare based on the ride selection
• The included modest gratuity
• Waiting time
• Cleaning or damage fees
• Cancellation fees

Drivers are paid per completed trip after applicable platform fees.

14. Conduct & Safety

The following are strictly prohibited in any Guardian Transport & Courier vehicle:
• Threatening, abusive, or disruptive behavior
• Harassment of any kind
• Illegal substances
• Weapons prohibited by any laws applicable in the geographic location where the ride occurs
• Smoking or vaping
• Consuming alcohol or carrying open alcoholic beverages
• Eating or drinking without Driver approval
• Interfering with Driver operations
• Any unlawful or unsafe behavior

Violations may result in account termination and potential involvement of law enforcement.

15. Insurance & Liability

All Drivers must carry insurance as required by Tennessee law.

For personal injury or property damage:
• Claims must be filed with the Driver’s insurance provider.
• Guardian Transport & Courier will assist in identifying the insurer.

Guardian Transport & Courier is not liable for:
• Lost income
• Missed appointments or flights
• Indirect, consequential, or third-party damages
• Delays caused by traffic, weather, or Driver conduct

Users must mitigate their own damages.

16. Platform Availability & Disclaimer

The Platform is provided “as is” and “as available.”
We do not guarantee:
• Continuous, uninterrupted, or error-free service
• Availability of Drivers at all times
• The performance, conduct, or reliability of Riders or Drivers

Guardian Transport & Courier LLC reserves the right to enforce all company standards and policies. Driver violates these Terms, safety requirements, or conduct expectations, we may suspend or permanently terminate their access to the Platform to protect the safety, integrity, and trust of the service.

17. Termination of Accounts

Accounts may be suspended or terminated for:
• Violating these Terms
• Fraud
• Unsafe or unlawful behavior
• Abuse toward Riders, Drivers, or staff

18. Intellectual Property

All app content, website content, trademarks, graphics, and technology belong to Guardian Transport & Courier LLC. Unauthorized use is prohibited.

19. Privacy

Guardian Transport & Courier collects and uses personal data-including location data, trip details, and payment information-for operational and safety purposes. Data is handled according to our Privacy Policy.

20. Uncontrollable Events (Force Majeure)

We are not responsible for delays or inability to provide service caused by events beyond our control, including but not limited to:
• Severe weather
• Traffic conditions
• Natural disasters
• Labor disputes
• Fuel shortages
• Mechanical failures
• App or system outages
• Government actions or emergencies

These events may prevent normal operation, and Guardian Transport & Courier LLC cannot be held liable for interruptions resulting from such circumstances.

21. Governing Law & Arbitration

These Terms are governed by the laws of the State of Tennessee.

Disputes shall be resolved through binding arbitration in Lewis County, Tennessee, under American Arbitration Association rules.

Users waive the right to a jury trial.

22. Changes to These Terms

We may update or modify these Terms at any time. Updates take effect immediately upon posting. Continued use of the Platform constitutes acceptance.
